Generative AI Terms

These Generative AI Terms ("AI Terms") govern your use of the artificial intelligence features provided by Layout, Inc. ("Layout," "we," "us").
These AI Terms supplement our Terms and Conditions and our Privacy Policy. They apply whenever you use any feature of the Services that relies on generative AI, including chat in our applications, ordering by text message, and our automated ordering system.
By using any AI-powered feature of the Services, you agree to these AI Terms. If there is a conflict between these AI Terms and our Terms and Conditions with respect to AI features, these AI Terms control. If there is a conflict between these AI Terms and our Privacy Policy with respect to personal data, the Privacy Policy controls.
1. Where We Use AI
Layout uses generative AI to:
Power the Layout Assistant in our mobile app, our web app, and our text message service
Interpret what you ask for and turn it into a structured order
Search and interpret merchant menus and locations
Operate the automated ordering system that places your order with a merchant
Support internal operations such as routing, quality checks, and reliability
Which AI systems are involved depends on the feature you are using and on how you access Layout.
2. Our AI Provider
Layout does not train or operate its own large language models. Generative AI processing is performed by Google LLC using the paid Google Gemini API.
What we send to Google
The messages you send in a Layout chat
Your first name, so the Assistant can address you
Your delivery or pickup address, when it is needed to find the nearest merchant location
Details of your recent orders, such as items and options, so the Assistant can make better suggestions
On text message and connector surfaces only, the last four digits of a saved card, so the Assistant can ask which card you want to use
What we never send to Google
Your phone number
Your full card number, expiration date, or security code
Any payment credential of any kind
How Google handles it
Google acts as a service provider to Layout. Under the paid Gemini API, Google does not use your prompts or the responses returned to you to train its models. Google's handling of data is also subject to its own privacy policy at https://policies.google.com/privacy.
We ask for your permission before your first message is processed. If you do not agree, you cannot use the Assistant.
We may add or change AI providers over time. If we do, we will update these AI Terms and our Privacy Policy before the change takes effect.
3. How Data Is Handled
Some of the information sent to our AI provider is associated with you. Your first name, your address when needed for merchant selection, and your recent order details are personal to you and are sent so the Assistant can do its job. We do not claim this processing is anonymous.
What we do limit:
We send only what is needed to handle your request. Card credentials and your phone number are never sent to an AI provider.
Your card details are stored only in Stripe's PCI DSS Level 1 compliant vault and never pass through an AI system.
Chat content is stored so you can view past chats. You can clear it, and you can delete your account. Both are described in our Privacy Policy.
Past order details are used to improve future suggestions for you.

4. Access Through Third-Party AI Assistants and Connectors
You may also reach Layout through a third-party AI assistant or application such as ChatGPT, Claude, Gemini, or Grok, or through our connector exposed over the Model Context Protocol.
On those surfaces, Layout generally does not run its own generative AI over your request. The assistant you are already using interprets what you said, decides what to ask Layout for, and calls our endpoints. Layout receives structured requests and returns structured results.
This means:
The interpretation of your request on those surfaces is performed by that third-party platform, under its own terms and privacy policy, not by Layout
Layout is not responsible for how that assistant understands your request, chooses items, builds an order, applies your instructions, or initiates a purchase
Whatever you type into that assistant is handled by that platform first, before anything reaches Layout
These AI Terms cover Layout's own AI features. They do not cover the AI systems of third-party platforms.
5. AI Output Can Be Wrong
Generative AI produces output based on patterns in data. It can be wrong.
AI features may misread a menu, misinterpret your request, select the wrong item, apply the wrong options or quantity, state an incorrect price or time, or behave differently than you expected.
You are responsible for reviewing and confirming your order before it is submitted, including the items, options, quantities, merchant, location, and total. Confirming an order authorizes Layout to place it and to charge you for it.
Estimated prices, availability, hours, and preparation times generated or relayed by AI features are approximate and are controlled by merchants, not by Layout.
6. Allergens, Ingredients, and Dietary Needs
Ingredient, allergen, and nutrition information shown or described by AI features comes from merchants and other third-party sources and is processed by automated systems. It may be incomplete, out of date, or wrong.
If you have a food allergy, intolerance, religious dietary requirement, or other medical dietary need, do not rely on AI output. Confirm directly with the merchant before consuming any item.
Special instructions passed to a merchant are requests only, and merchants are not required to follow them.
7. No Professional Advice
AI features do not provide medical, dietary, nutritional, legal, or financial advice. Do not rely on them for any of those purposes.
8. Your Responsibilities and Acceptable Use
You agree to use AI features lawfully and in line with these AI Terms and our Terms and Conditions.
You agree not to:
Attempt to extract underlying models, model weights, training data, or system instructions
Attempt to reverse engineer, copy, or recreate our AI systems or prompts
Use prompt injection or similar techniques to make AI features act outside their intended purpose or bypass safety controls
Use AI features to place fraudulent, fake, harassing, or abusive orders
Bypass or manipulate spending limits, fees, promotions, credits, or usage limits
Generate unlawful, harmful, infringing, deceptive, or spam content through the Services
Interfere with, overload, or disrupt AI features
Use output from the Services to train a competing machine learning model without our written permission
We may set technical and usage limits on AI features, and may suspend or restrict access if we reasonably believe they are being misused.
9. Changes to AI Features
We may modify, add, or discontinue AI features at any time. AI systems change frequently, and behavior you saw before may not be repeated.
10. No Warranty for AI Features
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL AI FEATURES AND ANY OUTPUT GENERATED BY OR THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LAYOUT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
LAYOUT DOES NOT WARRANT THAT AI FEATURES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AI OUTPUT WILL BE CORRECT, COMPLETE, OR SUITABLE FOR YOUR PURPOSE. LAYOUT MAKES NO WARRANTY REGARDING THE ACCURACY OF MENU, PRICE, INGREDIENT, ALLERGEN, OR NUTRITION INFORMATION.
11. Limitation of Liability
The limitation of liability in our Terms and Conditions applies fully to these AI Terms and to any AI feature or output, including our Assistant and our automated ordering system.
Layout is not liable for the acts or omissions of any third-party AI assistant, platform, or provider.
12. Changes to These AI Terms
We may update these AI Terms from time to time as our AI features and providers change. If we make material changes, including adding a new AI provider, we will provide notice before they take effect. Continued use of AI features after updated AI Terms become effective constitutes acceptance.
